Sears Holdings Files for Bankruptcy

Sears Holdings’ filed for bankruptcy today in the face of crushing debt and tightened credit terms.

The 866-store company, which will close another 142 stores as part of its reorganization, has several DTR licensing pacts, and in fact specifically mentioned those for for Joe Boxer (Iconix), Route 66 (Tempting Brands) and Jacklyn Smith (Jacklyn Smith International) in its filing. Sears Holdings is to receive royalty payments of 2.5-3.5 percent of sales under a 15-year agreement. Sears also has been seeking a buyer for Kenmore with Sears CEO Edward Lampert’s ESL Investments hedge fund having bid $400 million for the brand in August.

Sears has struggled for many years. It merged with Kmart in 2004, but has closed hundreds of stores in recent years amid mounting debt, $1.7 billion of which is due during the next two years.
